ORDER:

The present Writ Petition is filed for the following relief: …. to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the 2nd respondent in not taking any action on the Revision petition filed by the petitioner on 22.08.2019 against the orders of 3rd respondent the Assistant Director (V and S) and the same was rejected vide proceedings No.JA9P)/19(10)/2018-AD (V and S) ON 06.08.2019.is illegal, arbitrary and in violation of Principles of Natural justice and in violation of Art.14, 21 of the Constitution of India and consequently direct of the 2nd respondent to pass appropriate orders on the Revision petition filed by the petitioner on 22.8.2019 against the orders of 3rd respondent the Assistant Director (V and S) and the same was rejected vide proceedings No.JA9P)/19(10)/2018-AD (V and S) ON 06.08.2019 in the interest of justice and pass order or orders….

2. The grievance of the petitioner is that, as against the punishment order dated 19.07.2017, the petitioner has preferred an appeal before the 2nd respondent on 06.08.2017 and in view of the Covid-2019 the petitioner could not pursue the matter till 2022. Subsequently, the respondents, more specifically the 2nd respondent has not considered the revision petition filed by the petitioner on 22.08.2019 and disposed of and hence, the present writ petition.

3. The learned Government Pleader for Services-II has stated that the petitioner has not filed the revision in an appropriate format and he sought some time to dispose of the revision.

4. Considering the submissions made by both sides, without going into the merits of the writ petition, the Writ Petition is disposed of directing the petitioner to submit one more appeal in a format within a period of two (02) weeks from the date of receipt of a copy of this order, before the 2nd respondent and if any such appeal is filed, the 2nd respondent authorities shall consider the same and pass appropriate orders within a period of two (02) months from the date of filling of fresh appeal by the petitioner after providing an opportunity of hearing to the petitioner. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
