ORDER:

The present Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking a direction to restrain the beneficiaries from constructing houses on the lands allotted by the respondents in Survey No.118-2 on the ground that the petitioner’s industry is located at a distance of 200 meters away from the subject land.

2. When the matter was called, there was no representation for the petitioner.

3. Heard the learned Assistant Government Pleader for Revenue, appearing for the respondents.

4. The 4th respondent filed counter-affidavit stating that Ac.0.24 cents of land was identified by the respondents in Survey No.118 of Jaduru village of Meliaputti Mandal as suitable for constructions of houses, which is adjacent to Pattupuram village. It is further stated that the Revenue Divisional Officer, Palakonda has issued house pattas to 16 eligible beneficiaries of Pattupuram village.

5. In the counter-affidavit, it was categorically stated that the petitioner’s industry is located in Survey No.190-5B of Pattupuram Village of Meliyaputti Mandal but not in Survey No.118. Furthermore, the constructed houses are located at a distance of 250 meters away from the petitioner’s industry. It has also been pointed out that the petitioner is also beneficiary of patta in the same area.

6. The beneficiaries to whom the land was allotted and pattas were issued have not been made parties to the present Writ Petition.

7. The petitioner has not added the 16 beneficiaries of house sites, who are the real owners of the land, as parties to this Writ Petition. Hence, the Writ Petition is bad for non-joinder of necessary parties. Furthermore, the grievance of the petitioner appears to be political in nature and not a valid legal dispute.

8. In the absence of the beneficiaries, no effective order can be passed against them to stop the construction.

9. Accordingly, the Writ Petition is dismissed on the ground of non-joinder of necessary parties. No order as to costs.

Consequently, Miscellaneous Applications pending, if any, shall stand closed.
