ORDER:

1. This writ petition is filed aggrieved by the action of the respondents in not considering the petitioner’s case for promotion to the post of Deputy Director/Deputy City Planner which is highly illegal and arbitrary. Consequently, direct the respondents to forthwith consider the petitioner’s case for promotion to the next level cadre post of Deputy Director/Deputy City Planner without referring the common disciplinary proceedings dated 28.07.2025 and pass such other others.

2. Learned Government Pleader for Services-IV has placed the instructions of the Director of Town and Country Planning dated 03.02.2026. According to the said instructions, the respondents have issued the G.O.Rt.No.739, M.A&UD (VIG-I) Dept, dated 28.07.2025 stating that the Government has issued the Common Disciplinary proceedings under Rule 24 of A.P. Civil Services (Classification, Control and Appeal), Rules, 1991 (for short, the Rules, 1991”) and WSD is awaited from the individual.

3. Infact as per the A.C.B surprise check, a charge memo No.1595/2020/M1, dated 20.08.2020 was issued and subsequently Government has initiated the common disciplinary proceedings under Rule 24 of Rules, 1991 against certain employees including the petitioner vide G.O.Rt.No.373 MA&UD (Vig-I) Dept., dated 12.06.2023 and the same is pending.

4. Reply to the said contentions as far as the earlier charge memo is concerned, the petitioner has already approached this Court by filing W.P.No.3820 of 2024 for consideration of his case in terms of G.O.Ms.No.257, General Administration (Services-C) Department, dated 19.06.1999, but in the instant case, the prayer of the petitioner is that the respondents are not entitled to reject the case of the petitioner based on G.O.Rt.No.739 dated 28.07.2025. Though they have initiated the common disciplinary proceedings in the above said G.O.Ms.No.257 dated 19.06.1999 under Rule 24 of the Rules, 1991, but no charges were framed. Hence, the case of the petitioner has to be considered in terms of G.O.Ms.No.66 dated 30.01.1991. According to the said G.O.Ms.No.66 dated 30.01.1991, the promotions cannot be deferred without filing a charge sheet or serving a memo. In the instant case, as per G.O.Rt.No.739 dated 28.07.2025, no charges have been framed and served on the petitioner. Hence, the petitioner’s case may be considered without reference to G.O.Rt.No.739 dated 28.07.2025 for promotion to the post of Deputy Director/Deputy City Planner, in terms of G.O.Ms.No.66 dated 30.01.1991.

5. Accordingly, with the above observations, the writ petition is disposed of. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
