1. MALLAVOLU NIKITHA Counsel for the Respondent(S):

1. SREEDHAR VALIVETI

The Court made the following: ORDER: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)

Heard learned counsel for the petitioners and learned Standing Counsel for respondents/Bank.

2. Challenging the legal validity of the notice issued under Section 13(2) of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, ‘the Act’) by the respondents/Bank, the petitioners being the principal borrowers have filed this petition on various grounds that are urged in the writ petition. One of the grounds urged is that the secured asset is not registered with Central Registry of Securitisation Asset Reconstruction and Security Interest of India and there is a bar to proceed against secured asset under Section 26D of the Act, when the secured asset is not registered with Central Registry of Securitisation Asset Reconstruction and Security Interest of India.

3. Learned Standing Counsel for the Bank on instructions submits that the secured asset is in fact registered with Central Registry of Securitisation Asset Reconstruction and Security Interest of India but by mistake door number etc., relating to the secured asset was wrongly mentioned in the Central Registry of Securitisation Asset Reconstruction and Security Interest of India and they are taking steps to rectify the said defects and would submit that thereafter, they will issue fresh notice under Section 13(2) of the Act by withdrawing the earlier notice issued under Section 13(2) of the Act which is now questioned in this writ petition.

4. Therefore, recording the above submissions of the learned Standing Counsel for the Bank, as it is stated that they are withdrawing the impugned notice under Section 13(2) of the Act and that they intend to issue fresh notice and proceed further, the Writ Petition is closed. There shall be no order as to costs.

As a sequel, Interlocutory Applications pending, if any, shall stand closed.
