ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners, seeking the following relief:
<to issue an Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd Respondent in not considering representations of the petitioners dated 23.06.2017 and 02.11.2017 for entering their names in Digital Revenue Records for an extent of Acs. 5.50 in Sy.No. 132 and Acs. 2.20 cents in Sy. No. 135 and Acs. 2.79 cents in Sy.No. 136 (Total Acs. 4.99 cents), respectively of Cherlopalli village of CK Dinne Mandal, YSR Kadapa District, as illegal, arbitrary, unwarranted and in gross violation of principles of natural justice and in violation of Arts. 14, 19, 21 and 300-A of Constitution of India and consequently direct the 3rd Respondent Tahasildar, to consider representations of the petitioners dated 23.06.2017 and 02.11.2017, for entering their names in Digital Revenue Records for an extent of Acs. 5.50 in Sy.No. 132 and Acs. 2.20 cents in Sy. No. 135 and Acs. 2.79 cents in Sy.No. 136 (Total Acs. 4.99 cents), respectively of Cherlopalli village of CK Dinne Mandal, YSR Kadapa District, and pass …………….=
2. The matter has undergone two adjournments. The main prayer in the Writ Petition is to pass orders on the representations dated 23.06.2017 and 02.11.2017 for entering the names of the petitioners in Digital Revenue Records for an extent of Acs. 5.50 cents in Sy.No. 132 and Acs. 2.20 cents in Sy. No. 135 and Acs.
2.79 cents in Sy.No. 136 (Total Acs. 4.99 cents) respectively. Admittedly, the representations were not served upon the 3rd respondent – Tahsildar. Except for filing the representations, there is no endorsement, on the copies of the representations, to whom they were served. Therefore, this Court cannot direct the 3rd respondent – Tahsildar to pass orders on the same. In view of the reasons stated above, the Writ Petition is devoid of merits and is liable to be dismissed.
4. Accordingly, the Writ Petition dismissed. No order as to costs.
Consequently, Miscellaneous Applications pending, if any, shall stand closed.
