The contention of the petitioner is that the petitioner was appointed as Deputy Tahsildar under Group-II category in the year 2008 and subsequently he was promoted as Tahsildar in the year 2013 and accordingly he is discharging his duties. Basing on a complaint made by one A.Srinivasarao against one Y.Haribabu and others, the C.I.D. registered a case in Cr.No.43/2020 wherein the petitioner was included as accused no.9. Further the Government has also initiated disciplinary proceedings against the petitioner through G.O.Rt.No.727 Revenue Department dated 10.8.2023 in which the Joint Collector, East Godavari District has conducted enquiry and submitted enquiry report dated 04.8.2025 to the Government on 21.9.2025.

4. Learned counsel further submitted that in the disciplinary proceedings, already enquiry has been conducted and submitted report and as far as criminal petition is concerned, sanction granted against the petitioner was already stayed by this Court in W.P.No.22149 of 2025. In the said circumstances, the petitioner is eligible for inclusion of his name in the panel for 2025-26 falling for promotion to the post of Deputy Collector.

5. Respondent no.2 filed counter in which it is submitted that one more proceedings are pending against the petitioner. The District Collector, East Godavari District has framed articles of charges and submitted a report vide proceedings dated 20.9.2021 to the Government against the petitioner and one Sri K.Suresh Babu, the then Tahsildar, Rampachodavaram, now retired and the same is pending before the Government. Finally in the counter they have clearly mentioned in the D.P.C. for subsequent panel year 2025-26 as prayed by the petitioner is yet to be convened.

6. On perusal of the averments made in the counter and as per the submissions made by the learned counsel for the petitioner and learned Government Pleader, for the first charge the respondents have already concluded the enquiry and submitted a report and as far as criminal case is concerned, sanction granted by the Additional Director General of Police, C.I.D is already stayed by this Court. In the said circumstances, for preparing the panel for the year 2025-26, the respondents may consider the case of the petitioner in terms of G.O.Ms.No.257 dated 10.6.1999 basing on his seniority.

7. Accordingly, the Writ Petition is disposed of. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
