ORDER:

The present writ petition is filed seeking the following relief: <….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in issuance of the RC/EMC/D2/W1641/2025 Dated 5.2.2025 rejecting the claim of the petitioner that as and when stay orders dated 17.6.2020 in WP No. 9993/2020 on the Seniority or vacated the case of the petitioner duly placed before the Departmental Promotion Committee for promotion to the post of Superintending Engineer and other monitory benefits as applicable as per eligibility and other Rules in course as illegal, arbitrary and contrary to the orders passed by this Hon'ble Court in W.P.No.1641/2025 dated 24.1.2025 and also the guidelines issued by the Government of Andhra Pradesh in G 0 Ms No. 257 GAD Dated 10.6.1999, violative of Articles 14, 16 and 21 of the Constitution of India and for consequential direction directing the respondents to consider the case of the petitioner for promotion to the post of Superintending Engineer in terms of G.O.Ms.No. 257 GAD Dated 10.6.1999, without reference to the charges pending in GOMs No. 218, Water Resources (Vigilance 1) Department dated 2.5.2024 and to pass….=

2. Heard Mr. A.Sreedhar, learned counsel for the petitioner and learned Assistant Government Pleader appearing for the respondents.

3. The contention of the petitioner is that the respondents have rejected the case of the petitioner only on the ground of operating the stay in W.P.No.9993 of 2020 with regard to seniority. But surprisingly, the respondent authorities have considered and effected the adhoc promotions including juniors to the petitioner vide G.O.Rt no.12 dated 11.01.2025. But they have only denied the case of the petitioner on the ground of pendency of disciplinary proceedings. Hence the petitioner has requested to consider his case in terms of G.O.Ms.No.257 GAD dated 10.6.1999 for adhoc promotions to the post of Executive Engineer along with his seniors. Though the respondents have rejected his case vide impugned orders dated 05.02.2025 which is with regard to regular promotions and the regular promotion when the stay is operating with regard to seniority list.

4. Learned Government Pleader appearing on behalf of the respondents submitted that the Court may pass appropriate orders.

5. Considering the submissions, the respondents are directed to consider the case of the petitioner in terms of G.O.Ms.No.257 dated 10.6.1999 for effecting adhoc promotions without reference to the charges pending against the petitioner.

6. With the above observation, the Writ Petition is disposed of. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
