ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking the following relief:

“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in not conducting survey, demarcate and fix boundaries with respect to petitioner's land an extent of Ac 4-36 cents situated in Sy.No. 507/H2 of Rudravaram Village, Kurnool Mandal and District is illegal, arbitrary and contrary to the provisions of A.P. Survey and Boundaries Act, 1923 and consequently direct the respondent authorities to conduct survey and fix boundaries by demarcating the land and to pass …………….”

2. When the matter was taken up for hearing, on 09.02.2026, at the request of learned counsel for the petitioner, the matter was adjourned. Today, when the matter is called, Ms. M.S.V.Sudha Rani, learned counsel, representing Ms. M.L. Neelima, learned counsel for the petitioner, again requested for time.

3. On the other hand, learned Assistant Government Pleader for Revenue, on instructions, submits that the petitioner has preferred a Civil Suit in O.S. No.1464 of 2025 on the file of the Court of Principal Junior Civil Judge, Kurnool regarding the same subject property.

4. Since it appears that the learned counsel for the petitioner is not interested in prosecuting this case and the petitioner has already invoked the jurisdiction of the civil Court by filing O.S. No.1464 of

2025 on the file of the Court of Principal Junior Civil Judge, Kurnool, this Court finds it appropriate to dispose of the Writ Petition by directing the petitioner to pursue her remedy before the competent civil Court at Kurnool.

5. Accordingly, this Writ Petition is disposed of. No order as to costs.

Consequently, Miscellaneous Applications pending, if any, shall stand closed.
