ORDER:

This writ petition is filed declaring the action of the 3rd respondent in issuing proceedings dated 21.09.2024 thereby permanently discontinuing the services of the petitioner, as illegal and arbitrary.

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for the respondents.

3. Though counter has been filed, at the time of hearing, learned counsel for the petitioner has made his submissions based on merits. When learned counsel for the petitioner wants to argue the matter on merits, this Court is not inclined to entertain the writ petition as an appellate authority. When the statute provides an appeal provision, if the petitioner has any grievance with regard to non-consideration of the facts as per the records, remedy is to approach the appellate authority by filing a statutory appeal. Hence, this Court is not inclined to entertain the writ petition.

4. Accordingly, the Writ Petition is disposed of granting liberty to the petitioner to approach the appellate authority i.e., the Government as per Section 93 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 by filing an appeal. If any appeal is filed, the appellate authority shall consider the same and pass appropriate orders as expeditiously as possible, after providing a proper opportunity to the petitioner. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
