ORDER:

The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the action of the Respondent No.3 in issuing the impugned repatriation orders to the petitioner vide Rc.No. SPL/B3/2025, dated 28.06.2025, without any justified reason and without issuing any show cause notice to the petitioner or receiving any explanation or affording an opportunity of hearing and subsequent relieving orders issued by the respondent no.5 vide Rc.No.189/A/2025, dated 30.06.2025 relieving the-petitioner from Tirupati District as illegal, unjust, arbitrary and highly unjustified, in contravention of Principles of Natural Justice besides amounting to infringement of Fundamental Rights of the petitioner guaranteed under Article 14 and 21 of the Indian Constitution and principles of natural justice and consequently set aside the impugned repatriation orders issued by the respondent no.3 vide Rc.No. SPL/B3/2025, dated 28.6.2025 and subsequent relieving orders issued by the respondent no.5 vide Rc.No.189/A/2025, dated 30.06.2025 duly admitting the petitioner into service as Junior Assistant in the office of DIEO, Tirupati with all consequential proceedings and to pass such….”

2. Heard Ms. Kota Krishna Deepthi, learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.

3. Initially the petitioner used to work as Junior Assistant in Pullampeta, Kadapa District. Now the said part of area (after re- organization) falls within the jurisdiction of Tirupati District. Hence the petitioner is entitled to continue in Tirupati District. The petitioner was repatriated to Kadapa District which is not the local area of the petitioner. Hence, he made a request to consider his case for his parent district i.e. Tirupati.

4. Learned Assistant Government Pleader appearing on behalf of the respondents submitted that the Court may pass appropriate orders.

5. Without going into the merits of the case, liberty has been granted to the petitioner to make a representation with all relevant material to respondent no.2 within a period of two (02) weeks and if any such application is received, respondent no.2 may consider and pass appropriate orders for transfer of the petitioner into his parent district, within a period of two (02) months thereafter.

6. With the above observation, the Writ Petition is disposed of. No costs.

As a sequel thereto, interlocutory applications pending, if any, in the writ petition, shall also stand closed. __________________ JUSTICE D.RAMESH 05.02.2026 RD
