Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd Respondent temple to consider the Representations dated 07- 06-2024 and 04-07-2025 to permit the Petitioner to discharge his duties as Remuneration Barber No. 82 forthwith with and pass Counsel for the Petitioner:

2.GP FOR SERVICES II

The Court made the following ORDER:

The present writ petition is filed to consider the representations made by the petitioner for the restoration of the petitioner’s service as Remuneration Barber No.82 in the 3rd respondent temple.

The petitioner, a traditional Barber working on commission basis, was unable to attend duties due to severe Covid-19 infection, kidney surgery, and back problems. Certain barbers, owing to personal grudges, lodged a false complaint against him. An enquiry was conducted, and the Enquiry Officer found that no allegation was proved against the petitioner.

Though the enquiry report exonerating the petitioner was submitted nearly two months ago, the 3rd respondent has not restored his service despite representations dated 07.06.2024 and 04.07.2025. Hence, the inaction of the respondents is illegal, arbitrary, and violative of Articles 14, 16

and 21 of the Constitution of India.

Heard learned counsel for the petitioner and the learned counsel for the respondents.

Considering the submissions made by the learned counsel for the petitioner and upon perusal of the material available on record, including the representations dated 07.06.2024 and 04.07.2025, this Court deems it appropriate to dispose of the writ petition with a direction to the 3rd respondent to consider the said representations in accordance with law and pass appropriate final orders, within four (04) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall stand closed.
