ORDER:
The present writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: “…to declare the action of the 2nd respondent in issuing proceedings vide Rc.No.Ser.II-2/2627405/2024, Dt. 24.01.2025 wherein rejected the request made by the petitioners for grant of Minimum Time Scale on par with others is illegal, arbitrary, unjust, discriminatory and violative of Article 14 of the Constitution of India and also contrary to the Judgment rendered by the Hon'ble Supreme Court in "State of Punjab Vs. Jagjit Singh and others" and consequently set aside the same by directing the respondents to consider the case of petitioners for granting Minimum Time Scale to the post of Junior Lecturer (Vocational) with all consequential benefits ….”
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader appearing for the respondents.
3. Learned counsel for the petitioners submitted that the petitioners are stated to be appointed as part-time Junior Lecturers (Vocational) in different colleges, across different Districts, on different dates and are continuing to work as such; however, they have not been extended minimum time scale of pay. Hence, the writ petition is filed seeking extension of minimum time scale of pay as attached to the said posts and placed reliance on law laid down by the Hon’ble Apex Court in State of Punjab vs. Jagjit Singh and Others1.
4. Learned Assistant Government Pleader appearing on behalf of the respondents submitted that the Court may pass appropriate orders.
5. Considering the submissions, without going into the merits of the case, the respondents are directed to consider the case of the petitioners for extending payment of minimum time scale in terms of the judgment rendered by the Hon’ble Apex Court in State of Punjab vs. Jagjit Singh and Others within a period of two (02) months from the date of receipt of a copy of this order.
6. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
