ORDER:

The present writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: “…to issue a Writ, Order or direction particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not granting the Petitioners minimum of time scale of pay attached to the post in which they are working, as illegal, arbitrary, discriminatory and violative of Articles 14 and 16 of the Constitution of India as well as the law laid down by the Honourable supreme Court as well as this Honourable Court and consequently direct the Respondents to immediately grant them minimum of time scale of pay attached to the post in which they are working as revised from time to time….”

2. Heard learned counsel for the petitioners and learned Assistant Government Pleader appearing for respondents.

3. Learned counsel for the petitioners submitted that the 1st petitioner was appointed as an Electrician in the year 1998; the 2nd petitioner as an Electrician in the year 2016; the 3rd petitioner as a Fitter in the year 1998; the 4th petitioner as a Fitter in the year 2002; the 5th petitioner as a Fitter Helper in the year 1998; the 6th petitioner as an Electrician in the year 2012; the 7th petitioner as a Fitter Helper in the year 2016; the 8th petitioner as a Fitter Helper in the year 2012; the 9th petitioner as a Fitter Helper in the year 2020; the 10th petitioner as a Fitter Helper in the year 2016; and the 11th petitioner as a Fitter Helper in the year 2021. All of them are working in Kaikalur Grama Panchayat, Kaikalur Mandal, Eluru District (formerly Krishna District) and are continuing to work as such; however, they have not been extended minimum time scale of pay. Hence, the writ petition is filed seeking extension of minimum time scale of pay as attached to the said posts and placed reliance on law laid down by the Hon’ble Apex Court in State of Punjab vs. Jagjit Singh and Others1.

4. Learned Assistant Government Pleader appearing on behalf of the respondents submitted that the Court may pass appropriate orders.

5. Considering the submissions, without going into the merits of the case, the respondents are directed to consider the case of the petitioners for extending payment of minimum time scale in 1 (2017) 1 SCC 148

terms of the judgment rendered by the Hon’ble Apex Court in State of Punjab vs. Jagjit Singh and Others within a period of two (02) months from the date of receipt of a copy of this order.

6. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
