ORDER:
1. The present Writ Petition is filed declaring the action of the respondent authorities in not finalizing the departmental proceedings initiated in G.O.Rt.No. 315, Agriculture and Co-operation (VIG-II) Department, dated 10.04.2024, in respect of the incident of 2019–2021, though the petitioner was permitted to retire from service on 31.12.2020, in spite of submitting a reply on 24.06.2024, as illegal and arbitrary.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.
3. The contention of the petitioner is that the respondents have initiated departmental proceedings in G.O.Rt.No. 315, Agriculture and Co-operation (VIG-II) Department, dated 10.04.2024, in respect of the incident of 2019– 2021, which is after a lapse of four (04) years from the date of retirement from service. The petitioner submitted his reply to the said charge memo on 24.06.2024. Despite the same, even after a lapse of one and a half years, the respondents have appointed an Enquiry Officer, but the enquiry has not been proceeded with, which is contrary to the time stipulated under Circular Memo No. 24637/Ser.C/2000-2, G.A. (Ser.C) Department, dated 05.09.2000.
4. According to the said circulars, the authorities are required to complete major penalty proceedings within a period of six (06) months, but even after eighteen (18) months from the issuance of the charge sheet, the respondents have neither proceeded with nor contemplated proceeding with the enquiry.
5. Considering the submissions made and on perusal of the averments in the writ petition, without going into the merits of the case, this writ petition is disposed of at the stage of admission, directing the respondents to consider Circular Memo No. 24637/Ser.C/2000-2, G.A. (Ser.C) Department, dated 05.09.2000, referred to above, and take appropriate action within a reasonable period, not later than six (06) months from the date of receipt of a copy of this order. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
