1. The Court made the following:

THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION No.2016 of 2026 O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)

Heard Ms. Y. Bhanu Sri Akhila, learned counsel for the petitioners, and Ms. V. Dyumani, learned Standing Counsel for respondent Nos.2 and 3.

2. The petitioners are the guarantors. Challenging the measures initiated by the respondent bank under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, for realization of the loan amount due from the borrower as well as the petitioners, the petitioners have already approached the Debts Recovery Tribunal, Visakhapatnam, by way of filing Securitisation Application No.48 of 2026. Alongside the Said Securitisation Application, the petitioners have also filed an interlocutory application in I.A.No.257 of 2026, seeking stay of further proceedings initiated by the bank.

3. The limited grievance of the writ petitioners in this writ petition is that the said stay application is not being disposed of by the Debts Recovery Tribunal, even though there is an urgency in the matter.

4. Therefore, the writ petition is disposed of with a direction to the 1st respondent - Debts Recovery Tribunal, Visakhapatnam, to hear the stay application filed by the petitioners in I.A.No.257 of 2026 in S.A.No.48 of 2026 and decide the same on merits according to law on or before 27.01.2026 without fail. If the Presiding Officer of the Tribunal is not present, the I.A. shall be decided by the Officer holding full additional charge.

As a sequel, interlocutory applications, if any pending, in this case shall stand closed. There shall be no order as to costs.
