THE HON’BLE SRI JUSTICE BATTU DEVANAND AND THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA I.A.No.1 of 2025 In/and WRIT APPEAL No.1324 OF 2025

JUDGMENT:(Per Hon’ble Sri Justice Battu Devanand)

This Writ Appeal has been filed against the order, dated 31.07.2025 passed in W.P.No.19618 of 2025 by the learned Single Judge of this Court.

2. Heard the learned Government Pleader appearing for the appellants and Sri Naidu Siva Rama Krishna, learned counsel for the respondent No.1.

3. Perused the material on record.

4. The respondent No.1, who is working as Anganwadi Helper, K.J.Peta Anganwadi Center, filed Writ Petition against the termination order, dated 26.06.2025. At the stage of admission, the learned Single Judge of this Court, after hearing both sides and upon consideration of the facts and circumstances of the case, passed an interim order suspending the termination proceedings in No. 58 of 2025, dated 26.06.2025, for a period of four (04) weeks and posted the writ petition to 28.08.2025.

5. Challenging the said interim order, the present Writ Appeal is filed in the month of December, 2025.

6. Learned counsel appearing for the respondent No.1 would contend that, to avoid the contempt proceedings which were filed by the respondent No.1 in C.C.No.2497 of 2025, the appellant approached this Court by preferring this Writ Appeal.

7. Upon perusal of the order under challenge clearly shows that it is an interim order passed pending disposal of the main Writ Petition and the interim suspension also passed for a period of four (04) weeks only. If the appellants intend to challenge the interim order, they have to file Appeal before the expiry of time stipulated in that order. Filing of Writ Appeal after lapse of five months of the date of passing interim suspension order clearly establishes that, to avoid the contempt proceedings only, they preferred the present Appeal. Even on merits also, we do not find any infirmity in the order passed by the learned Single Judge. While granting suspension order, reasons are duly recorded.

8. In view of the aforesaid reasons, we are not inclined to interfere into the reasoned order passed by the learned Single Judge, which is now under challenge in the present Writ Appeal. The appellants failed to make any case either on law or on facts.

9. Accordingly, this Writ Appeal is dismissed. Consequent to dismissal of the Writ Appeal, delay condonation petition also dismissed.

10. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
