THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION No.28949 of 2025 O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)
As per the order dated 08.01.2026, interim direction not to take possession of the property was granted by this Court on condition of the petitioner depositing half of the outstanding amount within two weeks from the date of the order. This Court held that if the petitioner fails to deposit the said amount within the stipulated time, the interim order stands vacated without any further reference to the Court.
2. Admittedly, the petitioner did not deposit half of the outstanding amount within the stipulated time to comply with the condition imposed while granting the aforesaid interim order. Therefore, the interim order stood vacated by default on account of the failure on the part of the petitioner to deposit half of the outstanding amount.
3. Learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to the petitioner to approach the Debts Recovery Tribunal.
4. Permission is accorded.
5. Accordingly, the writ petition is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs.
As a sequel, interlocutory applications, if any pending, in this case shall stand closed. ________________________________________ JUSTICE CHEEKATI MANAVENDRANATH ROY
