1. NARESH BABU YERICHERLA Counsel for the Respondent(S):

1. CMR,J & GTK,J W.P.No.145 of 2026

The Court made the following: ORDER: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)

Heard learned counsel for the petitioners.

2. Challenging the measures initiated by the respondent No.2-financial institution under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, ‘the Act’), for realization of the loan amount by bringing the secured asset for sale, the petitioners have filed the instant writ petition.

3. The petitioners have got an efficacious remedy of approaching the Debts Recovery Tribunal, which is the appropriate forum constituted under the special enactment for redressal of such grievances. But, without approaching the Tribunal, the petitioners have invoked the extraordinary jurisdiction of this Court under Article 226 of Constitution of India. The Supreme Court has time and again deprecated the said practice of entertaining writ petitions when the petitioners got remedy of approaching the Debts Recovery Tribunal which is constituted for the said purpose. Therefore, we are not inclined to interfere in the matter and to entertain the writ petition.

4. Resultantly, the Writ Petition is dismissed. However, liberty is granted to the petitioners to approach the Debts Recovery Tribunal seeking redressal of their grievance. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed.
