ORDER:-

In this civil revision petition, the only limited grievance of the petitioner is that the petition filed by him seeking decree of divorce in F.C.O.P.No.926 of 2023 is not being disposed of expeditiously and sought direction to the trial Court to dispose of the same expeditiously.

2. Heard learned counsel for the petitioner.

3. Since the grievance of the petitioner is only to dispose of the F.C.O.P.No.926 of 2023 expeditiously as per the Case Flow Management in Subordinate Courts Rules, 2012, notice to respondent is dispensed with.

4. The petitioner is the husband and he has filed F.C.O.P.No.926 of 2023 seeking dissolution of marriage by way of passing of decree of divorce on the ground of cruelty against his wife. It was filed in the year 2023. The petitioner was examined as a witness and his examination-in-chief was recorded. But the matter has undergone about eleven (11) adjournments for a period of seven (07) months for cross-examination. Therefore, he seeks direction to the trial Court to dispose of the said divorce petition expeditiously.

5. As per the Case Flow Management in Subordinate Courts Rules, 2012, in Rule 3 pertaining to categorization of suits and other proceedings, sub- clause (b) covers divorce proceedings also and the said petition has to be disposed of within a period of 12 months from the date of appearance of the respondent therein. Since more than two years period has been expired after filing of the said petition and appearance of the respondent, still the petition is pending trial before the trial Court.

6. Therefore, the Civil Revision Petition is disposed of with a direction to the learned Judge of Principal Family Court, Vijayawada, to make an endeavour to dispose of F.C.O.P.No.926 of 2023 expeditiously, within a period of two (02) months from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any pending, shall stand closed.
