...RESPONDENT(S): Counsel for the Petitioner:

1. P VENKATA RAO Counsel for the Respondent(S):

1. M P CHANDRAMOULI

2. PUBLIC PROSECUTOR

3. A BHASKARA CHARY The Court made the following Order:

Learned Assistant Public Prosecutor placed on record the Report of the Station House Officer, Nellore Rural Police Station, who examined the Petitioner. From the said Report, it appears that the Petitioner had stated that at present she is not interested to proceed with the instant Criminal Revision Case.

2. The Criminal Revision Case cannot be disposed of for non prosecution; it has to be disposed of on merit only. Accordingly, the matter is taken up to pass an Order on merit.

3. The Instant Criminal Revision filed by the defacto complainant against Order of acquittal by the Courts below. According to the provisions of Section 372 of Cr.P.C an Appeal can be preferred by the defacto complainant against the Order of acquittal, but no revision is maintainable. Moreover, under the provisions of Section 401 (3) of Cr.P.C, prohibits a High Court from converting a finding of acquittal into one of conviction when exercising its revisional jurisdiction

4. Accordingly, the instant Criminal Revision Case filed by the defacto complainant against the Order of acquittal appears to be devoid of merit and same is hereby dismissed.

As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________ SUBHENDU SAMANTA, J
