ORDER:
One Smt.Govindalapudi Devi @ Sridevi filed an application before the learned Magistrate concerned under Section 12 of the Protection of Women from Domestic Violence Act, 2005, for getting maintenance from her husband and in-laws.
2. The said application was turned down by the learned Magistrate, against which the aggrieved petitioner filed an appeal before the learned Special Judge concerned. During the pendency of the said appeal, two separate applications vide Crl.M.P.No.723 of 2015 as well as Crl.M.P.No.724 of 2015 were filed under Sections 311 and 391 of Cr.P.C. respectively. Those applications were considered and allowed by the learned Special Judge against which the husband of the aggrieved wife has filed the instant criminal revision case.
3. A report has been placed on record by the learned Special Judge concerned wherein the appeal was pending. It was contended in the report that the Criminal Appeal No.399 of 2014 was disposed of on 26.02.2019.
4. Considering the fact that the order passed during pendency of the appeal is under challenge before this Court and the Criminal Appeal itself has been disposed of by an order of Special Judge concerned, at this juncture, the merits of the applications and orders thereof in the criminal appeal has no legs to stand upon.
5. Accordingly, the instant criminal revision case has become infructuous and the same is hereby disposed of as infructuous. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed. _______________________ SUBHENDUSAMANTA, J
