Mr. Prabir Banerjee

… for the petitioner

Mr. Tapan Kumar Mukherjee, ld. AGP Mr. Shamim Ul Bari … for alleged contemnor The application for contempt of the order dated22.12.1999 has been heard substantially.

The primary defence of the contemnors is thatthe directions in the order of 22.12.1999 wereunenforceable and inexecutable at the time when it wasmade and continues to be so.

It is emanating from the fact that there were nosanctioned vacant posts in the said Madrasah in whichthe petitioner/applicant would have to be inducted incompliance with or in execution of the order of22.12.1999.

Both parties have made substantial arguments. However, the arguments are not complete.

Post this matter for further hearing on16.04.2025.
