1. This application is for cancellation of pre-arrest bail granted by the Sessions Court by order dated 07.12.2024 passed in Criminal Bail Application No. 1102 of 2024 in Crime No. 0491 of 2024 for the offences punishable under Sections 352, 351(3), 324(4), 191(1), 119(1), 115(2) of the Bharatiya Nyaya Sanhita, 2023.

2. This application is filed essentially on the ground that the Sessions Court has committed error in recording prima facie findings with regard to non applicability of provisions of Section 119(1) of the Bharatiya Nyaya Sanhita.

3. It is contended by learned Counsel for the applicant that the said observations are incorrect and contrary to the allegations against 929-ACB-7-2025.odt

contesting respondents.

4. Learned APP sought appropriate orders on the basis of evidence collected during the course of investigation.

5. Learned Counsel for contesting respondents opposed application.

6. Perusal of the charge sheet indicates that offence under Section 119(1) of the Bharatiya Nyaya Sanhita was dropped for want of evidence to support the said change. In view of this fact that there is no justification in causing interference in the order of the Sessions Court. In any case the order impugned is reasoned order and appropriate in the facts of the case. Hence, application stands dismissed. (R. M. JOSHI, J.) B. S. Joshi 929-ACB-7-2025.odt
