1. This is an application for transfer of proceeding bearing PWDV Application No. 73/2026 under the Provisions of Protection of Women from Domestic Violence Act pending before the Court of Judicial Magistrate First Class, Pimpri-Chinchwad, Pune to the Court of Judicial Magistrate First Class, Sangamner, District Ahmednagar.

2. Respondents though duly served, chose to remain absent. This indicates that they are not interested in opposing the application.

3. Learned Counsel for the Applicant submits that there are two other proceedings i.e. proceeding filed by the Applicant against her husband and inlaws and marriage petition filed by Respondent- husband against her, are pending before the Court at Sangamner. It is his contention that having regard to said fact, no prejudice will be caused to the Respondents in case the application is allowed. It is his submission that the Applicant is a lady and is staying at her parental home at Sangamner. It is claimed that the Applicant is unable to appear before the Court at Pimpri-Chinchwad. Learned Counsel for Applicant submits that in case this proceeding is not transferred to Sangamner, prejudice and irreparable loss will be caused to the Applicant.

4. As recorded hereinabove, Respondents seem to be not interested in opposing the application. This Court, by order dated 06.08.2026, passed in Misc. Civil Application No. 135/2026 has allowed transfer application directing Marriage Petition No. 2045/2026 filed before Civil Judge Senior Division, Pimpri- Chinchwad to the Court of Civil Judge Senior Division, Sangamner. Undisputedly, there is proceeding filed by the Applicant against husband under Domestic Violence Act, which is pending before the competent Court at Sangamner. Having regard to this fact, no prejudice will be caused to the husband in case the application is allowed.

5. In view of above, application stands allowed. ( R. M. JOSHI, J.)
