wp10811.26 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 907 WRIT PETITION NO. 10811 OF 2026 YASHODA DAULAT KOLI VERSUS THE STATE OF MAHARASHTRA THR THE SECRETARY AND OTHERS Ms. Vaishali B. Suryawanshi, Advocate for the petitioner. Mr. P.S. Patil, AGP for the respondent-State.

CORAM

: KISHORE C. SANT & JITENDRA JAIN, JJ. DATE : 08.10.2026 PC :-

01. This Writ Petition is filed challenging an order passed by the Scrutiny Committee dated 18.08.2026 invalidating the tribe claim of the petitioner as belonging to the Scheduled Tribe – Tokre Koli.

02. Since the impugned order is dated 18.08.20026, learned AGP has raised objection about maintainability of this petition saying that now appellate remedy is available to the petitioner.

03. Learned Advocate for the petitioner, however, strenuously submits that though remedy is available, the office of the Commissioner is not fully prepared to hear the appeals within stipulated period. The petitioner is desirous of taking admission to MBBS course and therefore

wp10811.26 she needs validity at the earliest. If the parties are relegated to the Commissioner, she may not get judgment in time.

04. However, this Court is aware that the admissions to MBBS course are closing and it is not possible to take up this matter before the admission process is completed. In view of the same, this Court feels it proper to dispose off this petition with liberty to the petitioner to file appeal before the learned Commissioner. If such appeal is filed, the learned Commissioner to decide the appeal within 10 days from filing of the appeal. The petitioner also to give advance notice to the Scrutiny Committee, so that the Scrutiny Committee would be in a position to send original file to the Commissioner.

05. With the above, this Writ Petition sands disposed off. [JITENDRA JAIN, J.] [KISHORE C. SANT, J.]
