PER COURT :-

1.

Heard the learned Advocate for the applicants, learned Advocate for respondent no.2 and learned APP for the State.

2.

The present applicant is filed seeking quashment of the first information report bearing Crime No. 164 of 2025, registered with Mehunbare Police Station, District Jalgaon for the offences punishable under sections 498-A, 406, 323, 506, 504 read with section 34 of the Indian Penal Code and also the consequential filing of charge-sheet, criminal proceedings bearing Regular Criminal Case No. 442 of 2025

pending on the file of learned Judicial Magistrate, First Class, Chalisgaon Dist. Jalgaon alongwith orders passed therein.

3.

The learned advocate for the applicants, at the outset, submits that Applicant No. 5 and respondent No. 2 are husband and wife. There is a dispute among themselves of the matrimonial nature, due to which the present offence came to be registered against the applicants. He submits that the parties have settled the dispute among themselves and as per the order of this Court, they have appeared before the learned Registrar (Judicial). The report is filed in this Court.

There is an affidavit filed by Respondent no.2 clearly mentioning that the matter has been settled among themselves outside the court. The learned Advocate appearing for respondent No.2 reiterates and submits that there has been compromise and respondent no.2 has no objection, if the present application is allowed. Though on merit, the learned APP

raises objection, but he admits that there is compromise between the

parties.

4.

Taking into consideration that the dispute between the parties is of matrimonial nature and that the parties have settled among themselves, the present application is taken for quahshment on the ground of settlement.

5.

I have perused the charge-sheet and also the report filed by the learned Registrar (Judicial) dated 01.10.2026 in this court alongwith affidavit in reply filed by respondent no.2. The report of the Registrar (Judicial) confirms that the parties have been interviewed and they have stated that they have settled the disptue among themselves.

6.

Perusal of the affidavit of respondent no.2 suggests that the family, relatives and well wishers have intervened and resolved the dispute amicably between respondent no.2 and applicant no.5. and there are no more complaints or allegations pending against each other.

It is clearly stated that as they have settled the dispute among themselves, they mutually resolved to dissolve their marriage as well by filing a mutual divorce petition before the Civil Judge Senior Division, Chalisgaon. Paragraph no. 7 of the said affidavit states that the parties have agreed to settle the dispute on the permanent alimony of Rs. Six lakhs as and by way of full and final settlement of all maintenance and financial claims for herself and her minor daughter Kanika. The amount will be paid in instalments during recording of evidence in the

divorce proceedings. The consent has been accorded to quash the present criminal proceedings by respondent no.2 and the same is without any influence, coercion, pressure or fraud.

7.

Taking into consideration the affidavit filed by respondent no.

2 and also the fact that the parties have amicably settled the dispute among themselves nothing survives in the present criminal proceedings which require adjudication. The dispute between the parties is matrimonial in nature, which has now been privately resolved. There is no necessity of continuing the entire trial against the applicants.
