FINAL ORDER :

. Heard learned counsel Ms. Ketaki Sahastrabudhe for the petitioner.

2. The order passed by the respondent on 25.09.2025 U/Sec. 14-B of the Employees’ Provident Fund and Miscellaneous Provisions Act, 1952 (for the sake of brevity and convenience hereinafter referred as to the “Act”) is challenged in the present petition. It is informed that already substantive appeal U/Sec. 7- I of the Act is filed in January 2026, but the forum is not available. In the mean time the respondent has taken out coercive action of attaching the properties of the petitioner vide 2 75-WP-5041-2026 notice dated 30.03.2026. The petitioner is ready to deposit 50% of the amount with the respondent and seeks the protection.

3. No coercive action shall be taken against the petitioner, if 50% of the amount is deposited within a period of three (03) weeks from today with the respondent. If the petitioner fails to deposit the amount, action of recovery and/or attachment of the property shall stand revived.

4. This interim arrangement shall remain in operation till interim orders are passed in the appeal or final order is passed, whichever is earlier. The writ petition is disposed of.

5. Needless to mention that the amount deposited shall be subject to outcome of the appeal. [ SHAILESH P. BRAHME J. ]
