1. Heard counsel for the Petitioner.

2. Learned Counsel for the Petitioner submits that the Petitioner challenged Mutation Entry No. 414 on the basis of his right of inheritance in respect of the property for which the said Mutation Entry was recorded in favour of the Respondents. The Petitioner succeeded before the Tahsildar. However, in an appeal preferred by the Respondents, the order passed by the Tahsildar was reversed. The said order was thereafter upheld by the successive revenue authorities, including the Revenue Minister. Being

aggrieved by the same, the Petitioner has filed the present Writ Petition.

3. It is not disputed before this Court, and it is also observed in the order passed by the Minister, that Civil Suit No. 106 of 2020 has been filed before the Civil Judge, Junior Division, Satara, in respect of the same property, seeking a declaration of the rights of the parties.

4. It is settled law that the declaration of rights by the Civil Court would govern the revenue proceedings. In the event that either of the parties succeeds in the Civil Suit, such party would be entitled to seek rectification of the Mutation Entry in respect of the properties. The order passed by the Civil Court would be binding on the revenue authorities.

5. The Writ Petition stands disposed of with the above observation.

6. All contentions of the parties are kept open. (ARUN R. PEDNEKER, J.)
