ORDER:

INTERIM APPLICATION (ST) NO. 24097 OF 2026

1. Learned counsel for the respondents has tendered an affidavit-in-reply and the same is taken on record. This application is filed by the petitioner seeking leave to amend the petition as per the schedule of amendment, to add pleadings and prayer based on the subsequent events and developments. Learned counsel for the respondents opposes the prayer for amendment on the ground that the amendment, if allowed, would expand the scope of the writ varsha 9-wp-742 -2004-iast-24097-2026.doc petition.

2. I have perused the application. The proposed amendment is purely based on the subsequent events and subsequent development.

3. The writ petition is already admitted. Amendment if allowed would not amount to deciding the proposed prayer on merits. Since, the proposed amendments are based on the subsequent events, I see no reason why the prayer for amendment should not be allowed.

4. Interim application is allowed in terms of prayer clause (a). Amendment to be carried out within three weeks. Amended copy of the petition shall be served upon the learned advocate for the respondents. Reply if any to the amendments shall be filed within three weeks from the date of service of the amended petition.

5. It is clarified that all the rival contentions of the parties on merit of the proposed amendment are kept open. INTERIM APPLICATION NO. 14227 OF 2023

6. In view of the subsequent events as noted in Interim Application(St) No. 24097 of 2026, this interim application is rendered infructuous.

7. Interim Application is disposed of as infructuous.

8. Office shall verify whether the writ petition is ready for hearing. If the petition is ready for hearing, add the petition to the weekly final hearing board in the week commencing from 30th November 2026. (GAURI GODSE, J.)
