1. Heard the learned Counsel for the petitioner.
2. The challenge in this petition is to an order dated 19th January, 2026 passed by the learned Member, Maharashtra Revenue Tribunal, Mumbai, whereby while setting aside the order dated 13th June, 2022 passed by the Sub-Divisional Officer, whereby the delay in preferring an appeal came to be condoned, the MRT has not interfered with the order dated 2nd June, 2022, whereby the appeal was posted for hearing.
3. Since the MRT has set aside the order dated 13th June, 2022 condoning the delay in preferring the appeal and consequently the prayer for condonation of delay is required to be heard and decided first by the Sub-Divisional Officer, it is
24-WP12573-2026.DOC clarified that the Sub-Divisional Officer shall first hear and decide the aspect of condonation of delay and only in the event of condonation of delay the appeal be taken up for hearing and decision in accordance with law.
4. Subject to the aforesaid clarification, the petition stands disposed. [N. J. JAMADAR, J.]
