IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 13008 OF 2026 Mahindra Logistics Associates Union through its Secretary, Prashant Vishnu Mhaske

Petitioner … Versus : : Swabhimani

Shramik

Kamgar Sanghatana, through its General Secretary and Anr.

Respondents … Mr. Nitin Bhavar Patil for the Petitioner. Mr. V. N. Jadhav for the Respondent. CORAM: SANDEEP V. MARNE, J. DATED: 14 OCTOBER 2026. P.C.:

The Petitioner-Union is aggrieved by the order dated 9 September 2026 passed by the learned Member, Industrial Court, Pune rejecting applications at Exhibits-U A-2 and U A-4. It appears that the / / Petitioner-Union has opposed the deductions in terms of the Clause-7 of the Settlement on the ground that its members have not consented for PAGE NO.

such deductions. However, the Industrial Court has taken into consideration the ratio of the judgment in Balmer Lawrie Workers’ Union, Bombay and Anr. vs. Balmer Lawrie & Co. Ltd. and Ors.

1 in which it is held that even members of rival union are liable to pay the deductions in terms of the settlement clause.

In my view therefore, there is no warrant for the petitioner- union to intervene in the complaint filed by the recognised union. If petitioner has any grievance, it is free to agitate the same in independent proceedings.

The Writ Petition is accordingly disposed of. [SANDEEP V. MARNE , J.]
