family members, the applicant/accused came there and started abusing him and his family members. The learned Counsel for the applicant submits that, so far as the present applicant is concerned, it is alleged that he along with other accused persons entered the house of the informant, on the pretext that at the earlier point of time, applicant’s cousin brother had beaten the applicant’s nephew, and therefore, the applicant will take revenge. Thereafter they created ruckus by entering the house, damaged T.V., Sofa set and other properties, as also assaulted the informant and others with the help of deadly weapons. He submits that, there is no overt act on the part of the applicant, however, it is alleged that the family members of informant have been beaten whereas, the same has not been attributed to the applicant. applicant deserves to be granted anticipatory bail.

5. On the other hand the learned A.P.P. vehemently opposed the application by contending that the applicant created ruckus, along with other accused persons by tress- passing in his house and also assaulted the family members with deadly weapons. There are 4 injured persons, out of which one injured Mohsin had sustained 5th Metacarpel base fracture to right hand, which was a grievous injury. It is submitted that there are other injured persons also. In such circumstances, the applicant does not deserve grant of anticipatory bail, and prayed for rejection of the application.

6. Upon consideration of the submissions of the parties, apparently it appears that, the applicant and other accused persons had entered the house of the informant, since at the earlier point of time brother of the informant has assaulted applicant’s niece. It is to be noted that the accused persons have been named in the first information report. The applicant went along with them, created ruckus in the house of the informant and damaged the property belonging to the informant. Even the spot panchnama supports the allegations contained in the first information Rgd.
