1. By the application, the applicant is seeking condonation of 670 days caused in filing the appeal. Perusal of the averments made in the application shows that due to the administrative reasons the delay caused in filing the appeal. The appellant states that to show their bonafide is ready to deposit entire decreetal amount. Hence, stated that to contest the appeal on its own merit, the delay caused in filing appeal be condoned.
2. Learned Counsel appearing for the respondent did not file any reply to contravene the averment made in the application.
3. Hence, the delay of 670 days caused in filing the
41 caf 2027-2026.odt appeal is hereby condoned, subject to payment of costs of Rs.2500/- to ‘Public Welfare Account’ bearing No.129712010001014, IFSC Code UBIN0812978, Union Bank of India, Branch High Court, Civil Lines, Nagpur.
4. In the meantime, the appellant is at liberty to deposit the entire compensation amount along with interest to the Registry of this Court.
