2. Issue notice to the respondents.
3. Mr. Mohit Dube, learned counsel waives notice for respondent nos.1 to 5 and Mr. Ghogare, learned AGP waives notice for respondent nos.6 and 7.
4. By this application, the applicant is seeking the condonation of 1005 days in filing the application for restoration of appeal.
5. The learned counsel for the applicant has pointed out that inadvertently the paper book was not filed within a specified period as directed by this court and, therefore, the appeal was rejected.
6. However, considering the reasons stated in the application, the delay of 1005 days in filing the application for restoration of appeal is hereby condoned, subject to payment of cost of R.2,000/ to be deposited in the ‘Public Welfare Account’

1. By this application, the applicant is seeking the restoration of first appeal which was rejected for not filing the private paper book within a period of 12 weeks as directed by this court, vide order dated 05.09.2023.
2. The learned counsel for the applicant states that by 30.11.2026 the private paper book will be filed in the matter if the order is recalled.
3. Accepting the statement of the applicant, the order dated 05.09.2023 is recalled and the applicant is permitted to file the private paper book on or before 30.11.2026 Civil Application No.3769/2026 After restoration of appeal, list this application for further consideration on 21.10.2026.
