(1) 6 wp 5954-2026 IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH : NAGPUR WRIT PETITION NO. 5954 OF 2026 Rupesh S/o Krushnarao Bhongade VERSUS The Sub-Divisional Officer, Mauda, And Ors. -------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders -------------------------------------------------------------------------------------------------------- Mr. N.R. Raut, Advocate for petitioner. Ms M.S. Naik, AGP for respondent/State.

CORAM :

NANDESH S. DESHPANDE, J. DATED : 12.10.2026 Heard Mr. Raut, learned Counsel for the petitioner.

2. The order impugned in the petition is passed by the Sub Divisional Officer, Mouda, passed on 03.02.2026. It is the contention of the learned Counsel for the petitioner, that he was not arrayed as a party respondent and therefore has filed the present writ petition. I am afraid that such a course is not permissible. It is always open to the petitioner, if he is a person aggrieved, to file and avail the statutory remedy as provided under the Maharashtra Land Revenue Code.

3. In that view of the matter, writ petition is disposed with liberty to the petitioner to file a statutory appeal.

(2) 6 wp 5954-2026

4. It is made clear that if the question of limitation would arise in the statutory appeal, the Appellate Authority will decide the same in the backdrop of the fact that the petitioner had approached this Court and the said writ petition is being disposed of today.

5. All contentions of the parties are kept open. (NANDESH S. DESHPANDE, J.) Jayashree.. Signed by: Mrs. Jayashree Pethe Designation: PA To Honourable Judge Date: 13/10/2026 19:25:53
