Learned counsel for the petitioner submits that the execution proceedings filed by him pertain to a Gram Panchayat road, but he is unable to point out any material demonstrating encroachment on the said road. He, therefore, submits that he would file appropriate execution proceedings by giving details of the encroachment on the Gram Panchayat road. In view of the above, he seeks permission to withdraw the present petition with liberty to file a fresh execution proceedings.
Permission is granted. The petition is accordingly disposed of as withdrawn with liberty as prayed for.
