THE ELECTION COMMISSION OF INDIA AND ORS

Md. Babul Hussain

Ms. Shreya Poddar

… for the petitioner.

Ms. Anamika Pandey

… for E.C.I.

1. Petitioner and Election Commission are represented.

2. Learned advocate for the petitioner submits that the petitioner preferred an appeal before the learned SIR Tribunal. The said appeal was although disposed of but without any speaking order.

3. Learned advocate for the petitioner points to the report taken out from the portal of the Election Commission of India. Such report states that on March 30, 2026, the appeal was shown as ‘pending’. Subsequently, on August 13, 2026, the status of the appeal was ‘excluded from E-roll’. There is no corresponding order, as claimed by the petitioner.

4. In such circumstances, the appeal is remitted back to the learned SIR Tribunal for fresh consideration upon providing the petitioner an

2 opportunity for hearing and upon consideration of the documents produced by the petitioner having his Epic No. JGJ4425674.

5. WPA 27585 of 2026 is, accordingly, disposed of.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
