IN THE HIGH COURT AT CALCUTTA

CONSTITUTIONAL WRIT JURISDICTION

APPELLATE SIDE

WPA/23829/2026

In Re: MD. MUSTAK AHMED

Ms. Anamika Pandey,

…for the E.C.I.

1. None appears on behalf of the petitioner.

2. Ms. Anamika Pandey, learned Advocate represented the ECI submits that this writ petition may be disposed of as the prayer for expeditious disposal of SIR Appeal pending before the SIR Tribunal may be allowed in absence of the learned Counsel since this matter has been assigned before this Court for disposal.

3. Having heard the learned Counsel appearing for the respondent and upon perusal of the record, this Court finds this instant writ petition is filed for expeditious disposal of appeal pending before the SIR Tribunal. Such prayer is simple and innocuous. There is no impediment to passing such order even in absence of the petitioner’s Advocate.

4. Accordingly, the Appellate Tribunal is requested to consider and dispose of the SIR Appeal preferred by the petitioner as expeditiously as possible, preferably within a period of three months from the date of communication of this order.

5. It is needless to mention that this court has not gone into the merits of the case and the same may be decided independently and in accordance with law without being influenced by any observations made by this court.

6. Accordingly, the instant writ petition stands disposed of.

7. Urgent certified photocopy of this order, if applied for, be supplied to the parties taking all legal formalities.
