WPA 17320 of 2026 (Supravat Pal vs. State of West Bengal & Ors.)

Mohammad Mahmud Mr. Chottu Naskar …. For the Petitioner Mr. Indrajit Roy Chowdhury Mr. Jaydipta Mandal …. For the State S. M. Obaidullah Mr. Roni Chowdhury …. For the Respondent no. 7 Mr. Tamal Mukhopadhyay Ms. Saumalika Nandan …. For the Respondent nos. 5 and 6

The petitioner alleges that the private respondent has raised unauthorised construction without obtaining sanction from the concerned authority. Learned counsel for the private respondent points out that the representation submitted before the concerned authority on 18th April, 2026 is by the constituted attorney of the petitioner namely Suprakash Pal. However, the power of attorney was executed on 13th July, 2026, that is, after the representation was filed. Therefore, the constituted attorney had no authority to submit a representation on 18th April, 2026. Learned counsel for the petitioner submits that the petitioner intends to submit a fresh representation before the concerned authority ventilating his grievance.

In view of the above, liberty is granted to the petitioner to submit a comprehensive representation before the Pradhan, Satihan Gram Panchayat, being the 6th respondent herein, within two weeks from date. The 6th respondent is directed to consider and dispose of the same within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondent is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
