Learned advocate appearing for the petitioner submits that petitioner is in custody for 3 years and 10 months. There is no possibility of the trial being concluded in near future. As such, petitioner be released on bail.

State submits that 10 witnesses have been examined out of the 18 witnesses proposed.

I have taken into account the materials appearing and the merits of the present case. Merits of the case reflect that the present petitioner married two ladies. One of the ladies was at Bihar. Another lady was at the fringe of Kolkata. The prosecution story is that, because of some demand from the deceased, the petitioner allegedly terminated her life and threw

2 her away at a bridge. The body was thereafter recovered. The body of the deceased was kept in a morgue for considerable period of time for being identified. Police Authorities had to put in posters at different places to unearth the whereabouts of the relations. After much persuasion the police authorities were able to trace out the accused persons. The behavior of the present petitioner was very unnatural. There was no missing diary also as the wife was not available and there are materials connecting that a taxi driver has seen that the body of the lady was thrown away from the dickey of the vehicle.

Having regard to the heinousness of the offence, I am of the opinion the application of Article 21 of the Constitution of India, at this stage, would be inhuman. However, for indefinite period of time a person cannot be kept in custody. Learned Trial Court is directed to expedite the trial and within a period of 1 year from the date of communication of this order complete whole of the trial.

Accordingly, CRM (M) 2019 of 2026 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
