1. Heard both the parties.

2. Having heard the learned counsel for the petitioner and also taking into consideration the objection of the learned counsel for the State, I find that this is a fit case for granting bail to the petitioner since the case is based on circumstantial evidence. No person saw the accused committing the offence. The petitioner is in custody for about 4 months.

3. Considering all aspects of the matter, the application for bail of the petitioner, namely, Noor Alam @ Saheb is allowed.

4. I direct the petitioner will be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Twenty Thousand only) with two sureties of Rs. 5,000/- (Rupees Ten Thousand only) each, one of whom must be a local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Chandannagore. The petitioner shall

2 appear before the learned Trial Court on each and every day of substantive hearing subject to the provisions of Section 317 of the Code of Criminal Procedure, 1973/Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.

5. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

6. Thus, the application for bail being C.R.M. (M) 2388 of 2026 stands disposed of.

7. All parties shall act on the server copy of this order duly downloaded from the official website of this Hon’ble Court.

8. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
