CRR/284/2025

Sourav Mukherjee Vs. Sumita Mukherjee

Mr. Navanil De, Mr. Subhrajit Dey …for the petitioner Mr. Santanu Chatterjee, Mr. Rajendra Kr. Nandi …for the opposite party

This application has been preferred against the judgment and order dated 6th November, 2024 passed by learned Additional Sessions Judge, 1st Court, Alipore in connection with Criminal Motion No.84 of 2024 thereby set aside the order dated January 5, 2024 passed by learned Judicial Magistrate, 4th Court, Alipore. By an order dated 05.01.2024, learned Trial Court rejected the opposite party/wife’s prayer for interim maintenance. Being aggrieved by that order of rejection, the opposite party herein/wife preferred aforesaid revisional application before learned District Judge being Criminal Motion No.84 of 2024. By the impugned judgment dated 06.11.2024, learned Court below set aside the order passed by learned Magistrate and directed the petitioner herein/husband to pay interim maintenance of Rs.50,000/- per month to the opposite party/wife. Being aggrieved by that order, the petitioner/husband has preferred the instant revisional application.

2 However, at the time of hearing, learned Counsel appearing on behalf of the petitioner and learned Counsel appearing on behalf of opposite party/wife submit that the instant application may be disposed of by directing the Trial Court to dispose of the main application filed under Section 125 Cr.P.C. within a time frame in view of the fact that the petitioner/wife’s examination in chief has already been concluded and next date has been posted for her cross-examination. Having considered the submission made by the parties, the instant application being CRR 284 of 2025 is hereby disposed of directing the Trial Magistrate to dispose of the opposite party/wife’s main application filed under Section 125 Cr.P.C., preferably within 31st December, 2026. The Trial Court shall conduct day to day trial, if possible, and will make his best endeavour to conclude the hearing of the said maintenance case, without granting any unnecessary adjournment to either of the parties. It is also made clear that I have not gone into the merits of the instant application. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
