Mr. Srikanta Datta Ms. Adity Chakraborty Mr. P. K. Roy …. For the Petitioner Ms. Suva Gayen …. For the State

Affidavit of service filed on behalf of the petitioner is taken on record. Heard learned counsels for the parties. The petitioner was appointed as Clerk cum Typist in Suri I Panchayat Samiti on 5th September, 2002 and subsequently promoted as Deputy Secretary of Rajnagar Panchayat Samiti. He superannuated on 31st January, 2025. Despite completing all pension related formalities within due time, pension payment order was issued by the concerned authority 13th March, 2026. The gratuity amount and arrear pension were disbursed on 7th April, 2026. The petitioner seeks interest on the gratuity amount and arrear pension paid to him due to delay in disbursal of the same. Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Birbhum II, being the 2nd and 5th respondents herein, are directed to pay interest to the petitioner at the rate of 8% per annum on the gratuity amount and arrear pension calculated from 1st February, 2025 till the date of actual payment. Such payment shall be made within one month from the date of communication of this order. The writ petition is accordingly disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
