……for the Petitioner.

Mr. Parmananda Sharma, Ld. APP

Mr. Rajesh Kr. Shah

Mr. Manoj Kr. Singh

….for the State.

Learned advocate appearing for the petitioners submits that petitioners have been foisted with a criminal case because of trivial disputes.

State opposes the prayer for anticipatory bail and submits that there are injuries.

I have taken into account the injury report. Having regard to the overall circumstances in the present case, I am of the opinion that custodial detention of the present petitioners may not be warranted in the facts of the case.

As such prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioners, namely (1) Jyotish Roy @ Jyotish Ray, (2) Mithun Roy, (3) Jayanta Roy @ Mantu Ray be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted before this Court this order of anticipatory bail will remain in force for a period of 6 weeks from date. Accordingly, CRM (A) 3820 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
