1. The learned Advocate representing the petitioner submitted the petitioner to be in custody for 444 days. Two of the co-accused persons have already granted bail by the jurisdictional Court and seeking parity with the same. The prayer for bail shall be allowed.

2. The learned Advocate representing the State submitted the present petitioner to have been implicated in similar offences earlier in Cyber Crime P.S. Case No. 37 of 2024 dated 06.09.2024 under Sections 417/419/420/ 467/468/506/509/120B IPC and Ranaghat PS Case No.

dated 12.08.2024 under Sections 419/420/406/468/120B IPC. The present petitioner had been the principal accused to have commissioned the alleged offence with the assistance of the co-accused persons. There is every possibility of committing the similar offence if the petitioner is enlarged on bail. Moreover, lakhs of rupees had been defalcated and transferred to several accounts through cyber fraud activities. Though the charge-sheet has been filed in the instant police station case, however, due to the Trial Court being occupied with SIR activities the charges could not be framed.

3. The report submitted by the S.I. Bikram Pal of Cyber Crime Police Station, Ranaghat PD had mentioned that the petitioner having been enlarged on bail in connection with the aforesaid P.S. Case being Cyber Crime P.S. Case No. 37 of 2024 and Ranaghat PS Case No. 29 of 2024 had not violated the conditions. Let the copy of the said report be kept with the record.

4. Considering the period of detention and the co-accused to have been released on bail the prayer for bail in the instant case is considered and allowed.

5. Accordingly, Petitioner, namely, Supriyo Saha @ Ponka shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to

the satisfaction of Learned Additional Chief Judicial Magistrate, Kalyani, Nadia.

6. The petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of the Trial Court without prior permission from the same and the petitioner shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition the petitioner shall meet with the Officer-in-Charge of the local Police Station thrice a week until further orders.

7. In the event the petitioner fails to appear before the trial Court without justifiable cause, the Trial Court shall be at liberty to cancel his bail automatically without reference to this Court.

8. Accordingly, CRM (M) 2222 of 2026 is allowed.

9. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
