Re: CAN 1 of 2026 and CAN 2 of 2026

The petitioner seeks restoration of the writ petition which was dismissed for default by an order passed on 23rd March, 2026 and condonation of delay in filing the restoration application. Heard learned counsels for the parties. Good grounds being made out, the delay in filing the restoration application is condoned. The restoration application is allowed for ends of justice. The order dated 23rd march, 2026 is recalled. The writ petition is restored to its original file and number. CAN 1 of 202 6and CAN 2 of 2026 are accordingly disposed of.

Re: WPA 4906 of 2026 The petitioner alleges that the private respondent is raising unauthorised construction without obtaining sanction from the concerned Panchayat. The petitioner submitted a representation in this regard before the concerned authority on 15th December, 2025 which is yet to be considered. The petitioner seeks consideration of the same. Learned counsel for the private respondent denies and disputes the allegation raised against him. In view of the fact that the representation is pending, the Pradhan, Begri Gram Panchayat, being the 2nd respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The decision taken by the authority shall be communicated to the parties within in a week thereof. In the event the construction raised by the private respondent is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
