In the matter of : Amit Das

… Petitioner(s)

Mr. Prabir Majumder Ms. Anindita Kundu

… for the Petitioner(s) Mr. Anindya Ghosh Mr. Pronojit Roy

… for the State-respondent(s) Mr. A. Rakshit

… for the Victim

Learned advocate for the petitioner submits that the petitioner is in custody for one year six months; charge- sheet has been submitted and charges have been framed. Learned advocate also submits that four witnesses till have been examined. State opposes the prayer for bail. Learned advocate for the defacto-complainant also opposes the prayer for bail. I have taken into account the statement of the victim under section 183 of the BNSs. Having considered the same, I am of the opinion that the petitioner be released on bail on stringent conditions.

Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Amit Das shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under POCSO Act, Krishnanagar, Nadia. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Nadia without prior permission of the learned Special court/trial court or the court in seisin of the case. Additionally, the petitioner shall not enter the jurisdiction of Krishnanagar Kotwali Police station except for the purpose of attending the court till the evidence of the prosecution witnesses is over. Accordingly, CRM (M) 2417 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence and the report submitted be kept with the record.

Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
