1. Learned counsel for the petitioner submits that the petitioner is an aged person and he was not involved in the commission of alleged offence. The petitioner is in custody for 70 days. The investigation is complete. There is no need for further detention of the petitioner.

2. Learned counsel for the State vehemently opposes the prayer for bail of the petitioner and submits that there are sufficient incriminating materials against the petitioner and as such, the prayer for bail should be rejected. According to her, the petitioner absconded for several months and only after submission of the chargesheet the petitioner was arrested. Learned counsel for the State has also submitted that the murder of the deceased was done in a premeditated manner. If the petitioner is enlarged on bail, there is further chance of abscondence.

3. I have gone through the materials on record. It appears that the petitioner was very much present at the place of occurrence. Although he is not the principal assailant but one of his son committed the gruesome murder of the brother of his daughter-in-law

4. In view of above, I am of the opinion that as the petitioner absconded for a quite some time, there is further chance of abscondence if the petitioner is enlarged on bail.

5. Accordingly, the prayer for bail of the petitioner stands rejected at this stage.

6. With the above observations, the instant application for bail is dismissed.

7. Case diary be returned to the learned advocate appearing for the State.

8. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.

9. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
