IN THE HIGH COURT AT CALCUTTA Item No.67

CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 2156 of 2026

In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Raiganj Police Station Case No. 1153 of 2025 dated 09.10.2025 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And

In Re : Susanta Rabidas ... Petitioner.

Ms. Minoti Gomes, Mr. Jisan Iqubal Hossain

... For the Petitioner.

Mr. Kaustuv Shome, Mr. Deepak Khetawat

... For the State.

Learned advocate appearing for the petitioner submits that from the joint possession of the petitioner and others 296.01 grams of Heroin was recovered and petitioner is in custody for one year; although charge-sheet has been submitted, but there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as there has been no change of circumstances since the last rejection on 29.06.2026. Having regard to the stage of the case particularly, when PW-1 has been partly examined, I am not inclined to release the petitioner on bail at this stage. As such, the prayer for bail of the petitioner is rejected.

Learned Trial Court is directed to prepone the evidence of independent seizure list witnesses and complete the same within a period of four months from the next date fixed. Petitioner will renew his prayer for bail after the evidence of the independent seizure list witnesses is over. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2156 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
