CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 2120 of 2026

In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with NCB Crime No. 12/NCB/KOL/2025 dated 05.06.2025 under Sections 8(C)/20(b)(ii)(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And

In Re : Raju Sk. ... Petitioner.

Mr. Arnab Chatterjee, Mr. Avik Ghosh, Ms. Ankusha Ghosh

... For the Petitioner.

Mr. Dipankar Dandapath, Mr. Pradip Kumar Kundu

... For the NCB.

Learned advocate appearing for the petitioner submits that petitioner is in custody since 05.06.2025, charge-sheet has been submitted, charges have been framed and till date, three witnesses have been examined out of eight witnesses proposed by the prosecution. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the NCB, on the other hand, opposes the prayer for bail. Having considered that the prosecution case is based on recovery of 112.5 kgs. of Ganja from the joint possession of the petitioner and another, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Petitioner be well advised to approach this Court after the evidence of independent seizure list witnesses is over. Learned Trial Court is directed to insist on examination of the seizure list witnesses preferably within a reasonable period of time. Report submitted by the learned advocate appearing for the NCB be kept with the record. The application for bail, being CRM (NDPS) 2120 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
